Federal court records filed Thursday show until the time of that hearing Moody will remain in the custody of the government.
The hearing is scheduled for 2 p.m. at the United States Courthouse annex in Greenville.
Meanwhile Thursday, United States Magistrate Judge Kimberly A. Swank signed an order that showed Moody was eligible for appointment of a federal public defender in his case at the expense of the government. “The court further determines that the defendant is unable to pay the fees of any witness, and … the clerk shall issue a subpoena for any witness necessary to present an adequate defense to the pending charge or charges,” the order said.
Motions for discovery were also filed in the case Thursday.
The DEA charged Moody Wednesday with conspiracy to distribute and possession with intent to distribute 5 kilograms or more of cocaine.
