The attorney representing former Roanoke Rapids police Chief Bobby Martin submitted a voluntary dismissal with prejudice to all claims he filed against a consulting group, according to court documents.
While attorneys representing Martin and the Richardson and Davis Consulting Group and Richardson, Davis & Forest Consulting Group did not immediately respond to a request seeking comment today, Roanoke Rapids City Attorney Geoffrey Davis did confirm the voluntary dismissal filed June 11 resolves the case.
The lawsuit Martin filed against the city and City Manager Kelly Traynham was voluntarily dismissed with prejudice on May 27.
Martin claimed in the lawsuit that R&D made numerous misrepresentations and erroneous findings in its report that were biased against him.
Among other claims, Martin alleged in the lawsuit that the company’s bias was exemplified in its unjustified conclusion that Martin had been untruthful to the city manager regarding the status of any investigation of a department head.
The company countered with the following claims against Martin:
He failed to accurately report statements and actions made by him in his employment as police chief.
He failed to fully answer interview questions.
He failed to provide additional information and witnesses with regard to the specific topics known to him that would be investigated.
He failed to use reasonable care, and was careless and negligent in other respects to be proven at trial.
Martin claimed in the complaint that his termination by Traynham was malicious and corrupt. He alleged it was motivated by a personal desire to protect a department head, protect her advantageous political connections with that department head and other local politicians, and retaliate against him for taking legitimate and valid actions.
Martin was fired from his job in April 2023.
