Ervin Hughes was ordered imprisoned for 120 days as part of the order for revocation of his federal supervised release.

District Judge Terrence Boyle signed the order on October 6. It was published to the federal online database on Tuesday.

No supervision is to follow after the 120-day sentence is served, according to the order.

The order says that on November 7, 2017, Hughes, of Garysburg, appeared before Boyle in a case in which he had pleaded guilty to possession with intent to distribute a quantity of cocaine and possession of a firearm in furtherance of a drug-trafficking crime.

Boyle sentenced him to a 75-month prison term with the stipulation of 36 months of supervised release upon the completion of the original term.

His supervised release began on May 27 of last year.

“From evidence presented at the revocation hearing on October 6, 2023, the court finds as a fact that Ervin Rodell Hughes, who is appearing before the court with counsel, has violated the terms and conditions of the judgment …”

The violations were:

Using a controlled substance

Failure to participate as directed by the probation officer in a treatment program for narcotic addiction, drug dependency, or alcohol dependency

Criminal conduct 

Hughes had been wanted by the United States Marshals Service and was arrested September 4 shortly before 1 a.m. while Weldon Officer A. Dickens and Corporal I. Smith were at the 51 Sycamore Bar and Grill.

They observed Hughes walking to his vehicle and Chief Christopher Davis said he appeared to be intoxicated.
