The court allowed continuance of Gerald Whitaker's arraignment to November 15. “The court has determined that the ends of justice outweigh the interests of the defendant and the public in a speedy trial time,” the order says.
The office of the public defender, which is representing Whitaker, requested a 60-day period to file pre-trial motions in the case. “ Counsel for the defendant is requesting additional time to meet with Mr. Whitaker to review the discovery material and plea agreement which has been proposed by the government, and to determine how Mr. Whitaker wishes to proceed with this matter,” the motion says.
The motion reveals no details of the proposed plea arrangement.
Whitaker is charged with knowingly and intentionally distributing a quantity of heroin on July 8 of 2013, while a second count charges the same on July 22 of 2013.
The indictment notes, “The defendant committed the violations in counts one and two after two or more prior convictions for felony drug offenses had become final.”
