Mills returned to federal custody

Tyron M. Mills is in custody of the U.S. Government, the Halifax County Sheriff's Office and federal court records confirm.

Mills, who was wanted by the federal government after he reportedly broke terms of his release, had his initial appearance today before United States Magistrate Judge K.A. Swank, Lieutenant Anzell Harris of the sheriff's office said in a statement.

He was remanded to the U.S. Marshals Service custody, and has a detention hearing scheduled for Friday in U.S. Court.

Harris could not comment beyond the statement.

Federal court records filed today do show Mills will be assigned a federal public defender as the government works to revoke his release.

The Roanoke Rapids Police Department executed and returned the warrant for Mills' arrest on Monday, court records show.

The federal warrant filed after his arrest by the sheriff's office in the Lincoln Heights community explains he was charged on February 12 with felony possession with intent to sell and deliver marijuana, felony possession of marijuana, felony maintain a vehicle, place or dwelling to keep a controlled substance and misdemeanor possession of drug paraphernalia. “The charges —14CR50540 and 50541— are pending in Halifax County District Court, Halifax, North Carolina, with a court date of March 5, 2014,” the arrest warrant says. “The defendant posted a $30,000 bond on February 15, 2014, and was released from custody pending trial.”

The warrant continues, ”In view thereof, we respectfully petition the court for the issuance of a warrant and recommend that the term of supervision be revoked. Since the defendant has pending criminal charges, it is recommended that this petition and order be placed under seal until execution of the warrant. The purpose of sealing this document is to facilitate officer safety and to disallow the defendant's knowledge of issuance of the warrant.”

The petition this evening remained sealed.
