City revokes Goldmine business permit

The city has revoked the business use permit for Goldmine Bar and Lounge in Becker Village Mall, according to documents filed with the planning and development department.

The documents setting up the revocation do not specifically deal with a shooting and fight that occurred at the establishment early New Year's Day, but with withdrawal of permission by mall management to use its restrooms.

Roanoke Rapids Police Chief Chuck Hasty said the shooting, fight and any possible alcohol violations remain under investigation with assistance from state Alcohol Law Enforcement.

“The business is not compliant until restrooms are provided or the previous mall agreement has been renewed,” wrote city Planning and Development Director Kelly Lasky in a letter to Jasmine Pitt dated Friday. “You must meet requirements of Chapter 4 of the North Carolina 2012 Plumbing Code concerning restroom facilities for your business. You must also maintain proper licensing with the city's Tax Department to operate your business. On December 23, 2014, you were made aware that you must have a beer/wine license. That license was not obtained.”

The letter informed Pitt that revocation of the business license was effective Friday. “Operation of all business activities shall cease immediately. The permit may be reinstated after an approved inspection for compliance with the North Carolina Building Code by the code enforcement officer.”

In email correspondence attached to documents requested by rrspin.com, Lasky noted, “To reinstate the permit we are looking for the construction of restrooms within the tenant space or a renewed agreement for use of mall restrooms. These options are acceptable to the planning department. The decision is between the landlord and tenant.”

On Thursday, mall General Manager Ravichandra “Rob” Mulukutla notified city Code Enforcement Supervisor Brian Duhadaway that permission for Goldmine to use the mall's restrooms had been withdrawn.

Under those terms, Mulukutla wrote, the bar could use the mall restrooms during the lounge's business hours. Those hours were Thursdays from 7 p.m. to 1 a.m.; Fridays from 7 p.m. to 2 a.m., and Sundays from 7 p.m. to 1 a.m.

“Due to the violation of the agreement which Goldmine executed with Becker Village Mall, I withdrew the permission which I gave on December 18th, 2014, to Goldmine Bar & Lounge to use the mall hallway restrooms during the above-mentioned hours. Effective January 1, 2015, Goldmine Bar will not have permission to use the restrooms of the mall.”

The general manager noted that violations included opening the bar on December 31 without notifying him, which was not the published opening hours; alarm activity on December 25 at 11:55 p.m., and January 1 at 12:15 a.m. due to the improper security and safety measures in the mall building after 9 p.m.

Pitt requested permission to use the mall restrooms on December 11, noting that the establishment would have three security guards, one at the Goldmine business door entrance, one at the mall's business door to the hallway and one at the public restrooms to keep the mall secure. “Goldmine will keep the mall's restroom completely clean and sanitized,” Jasmine and Stevie Pitt wrote in the letter. “Goldmine guarantees that the mall alarm system will not (be) disturbed during usage of the restrooms. A barricade will be kept as shown in the diagram below to avoid the customers going (down) hallways other (than) the restrooms. We will be responsible for any false alarms that may be caused in this arrangement.”

Mulukutla notified Duhadaway on December 18 he granted permission before withdrawing that permission Thursday.
